SPECIAL BOARD MEETING
Collection Center – Landfill Site Visit

The Rutland Town Board will meet with representatives from WDNR and Strand Associates to discuss the status of the site activities over the summer and the burning site license.
The meeting convened at the Rutland landfill site shortly after 4:00 p.m. Present were Rutland Board members Chairman Beske, Supervisors Lunde, Shapiro Hurley and Sperle, Clerk George, Patrolmen Wethal and Wendt, and DNR representatives James Kralick and Percy Mather.
Kralick introduced Percy Mather who is a Recycling Specialist. She spoke briefly at this time and later regarding the Town’s Burning License.
Kralick hand delivered copies of a letter dated September 6, 2007 on the Closed Landfill Status Report on the work completed since the discovery of elevated levels of vinyl choride and benzene were discovered in monitoring wells MW-1 and MW-3 in October and December 2006. The letter outlined additional actions the DNR believes are necessary for the Town to maintain compliance with solid waste regulations and protect human health and safety.
In the letter, Kralick commented that the consultant will need to assign numbers to the replacement well and any private wells tested. The consultant will also need to provide a final copy of the site plan.
If future testing reveals indicates a presence of petroleum contamination, the DNR may require that an electo-magnetic survey be conducted to determine if a source of petroleum contamination exists on the property.
Kralick is now recommending a monitoring schedule for semi-annual testing of the monitoring wells at the landfill site with testing done for the following parameters: alkalinity, hardness, volatile organic compounds (VOCs). Field conductivity, field pH, field temperature and groundwater elevation. In addition, it is recommended that annual testing be done on seven private wells in the area. In the past, testing was done on six properties. Kralick is recommending the addition of the Krueger (formerly Combs) property as recent results indicate a possible easterly flow direction. The Krueger property is located about 1200 feet east of the landfill property. If the revised groundwater monitoring schedule is acceptable to the Town, the Town will need to proceed by sending the WMM Program a Plan of Operation Modification request. Kralick will then prepare a draft Plan of Operation for the Town to review. There will be a $1650 fee to review and process the modification request. The Plan of Operation will be a legal document that will protect both parties and can not be changed on a whim. If after a few years (Kralick advised that two years would probably not be sufficient), problems have been resolved and the Town would request to modify the testing schedule, there may or may not be another fee charged.
Beske advised both Kralick and Mather of the changes that the Town has made and will be making in order make the site more secure. In addition, Beske advised them of the importance of the Town having a wood burning permit both for use by both the Town patrolmen and Town residents. The Patrolmen need to have a place to burn the brush that is cleared from the 46 miles of town roads for everyone’s safety. We also need to do all that we can to encourage town residents to recycle and to have a place to bring brush instead of it being deposited in inappropriate places.
In 1992, the Town of Rutland submitted the required fee and application for a burning permit. The Town was under the impression that the license was in effect. Kralick and Mather have indicated that the license fell through the cracks and are therefore asking that a new application be submitted. There is an annual license fee of $165 and in addition to this fee, there will be a review fee of $550 due with the initial application. Mather gave the clerk documents to be used for a burning pad license application. The licenses are issued from October 1 to September 30 of each year. It is probably not possible to get the application completed and submitted to the DNR in time for the license to take effect October 1 of this year.
The Town will need to take the steps necessary to proceed with a new Plan of Operation and a new Burning Pad license.
