BOARD MEETING

November 6, 2007 –6:30 p.m.

 

1.      Appearance by Dane Co. Sheriff Dept. representative.  Community Deputy Cindy Holmes presented the monthly stats report.  She noted that Dane County has had a high number of burglaries; Rutland has had several reported burglaries.  Holmes suggested the Board consider adopting a Direct Sellers Permit Ordinance and presented a draft of a neighboring town as well as the County Ordinance (Chap. 61).

2.      Constable Report. The constable had no reports.

3.      Report from Planning Commission and any action necessary.

·        Duane Swalheim, agent for Robert Meyer, inquiry regarding possible splits for property at 3956 Hwy 138.  Duane Swalheim appeared on behalf of Bob Meyer.  They may split the house and buildings (approximately 4 ½ acres) from the remainder of the farm by a separate CSM.  The number of remaining splits was reviewed.  This number is either 8 or 9 as 1979 tax roll has farm at 282.5 acres.  Present tax roll is 279.5 acres.  Setbacks were explained for a CSM.  The property will be viewed on Saturday, November 10th, at 8:30 p.m.

6.      Consideration and action on Resolution regarding fire territory changes.  Action on:  Resolution No. 07-11-04 Approving Amendment 4 to Oregon Fire/EMS contract and authorizing execution of Amendment 4.  Shapiro Hurley moved, Sperle seconded, to adopt Resolution No. 07-11-04; motion carried 4-0. 

7.      Consideration and action to adopt a revised fee schedule to increase the solid waste disposal bag charge.  Shapiro Hurley moved, Lunde seconded, to approve a revised addendum (Fee Schedule) to Ordinance 06-12-01 to reflect an increase in the per bag fee charged at the collection center from $1.50 to $2.00 per bag; motion carried 4-0.  This will be effective as of November 15, 2007 when published.

8.      Consideration and action to adopt resolution opposing ATC line construction in the town.  Shapiro Hurley moved, Sperle seconded, to adopt Resolution 07-11-05 recommending that the proposed 345kv power line be placed on the northern route along the beltline; motion carried 4-0.  A copy of the resolution will be sent to ATC and the Public Service Commission.

9.       Consideration of and necessary action on proposal for soil boring on Oak Ridge Rd.  The Board reviewed the proposal submitted by Soils and Engineering Services, Inc.  No    action was taken and the matter will be further addressed at the December meeting.

10. Consideration and necessary action on roller joint purchase.    This item will be addressed further at another meeting when further information is received regarding tracking usage of each municipality, insurance and storage.  Todd Klahn, Town of Dunn, will be asked to submit a written proposal.

11. Update and necessary action on status of Landfill course of action.  A proposal was received from Strand Associates for out of scope services provided in 2007 and Tasks and Proposed Fees for 2008.  Beske will contact Luke Hellerman at Strand to clarify that the DNR reports will be included in the proposal for 2008 and questioning the cost of getting a ball-park figure for an electro-magnetic survey if necessary due to increased or continuing contamination.  The DNR has requested a plan modification that would involve two samplings in 2008 (March/April and April/October.  The spring sampling will include both the monitoring wells at the collection center and the private wells surrounding the collection center site.  Jim Kralick, WDNR, also said that the results conveyed in the October letter from Steve Small, Strand Associates) were not submitted in GEMS format.  A check of the records show that the forms were signed on August 8th by the clerk and the disk containing the results in the correct formatting were submitted at that time.

12. Reports of meetings attended by the Board as necessary.  The Chair, the Clerk, and Supervisor Lunde reported on meetings attended at the Wisconsin Towns Association Convention.

13. Adjournment of the November 2007 meeting on motion and second by Sperle and Shapiro Hurley; motion carried.

RESOLUTION No. 07-11-05

Recommendation regarding 345kv power line

 

The Rutland Town Board does hereby on November 6, 2007, recommend to the American Transmission Company that the new power line be placed on the “Northern Route”.  Thereby, the Rutland Town Board goes on record officially opposing any placement of the power line on the “Southern Route”.

RESOLUTION NO.:  07-11-04

 

RESOLUTION APPROVING AMENDMENT 4 TO CONTRACT, EFFECTIVE OCTOBER 17, 1995, PROVIDING FOR THE JOINT OPERATION AND MAINTENANCE OF FIRE PROTECTION AND EMERGENCY MEDICAL SERVICES, AND PROVIDING FOR A PLAN OF ADMINISTRATION FOR SUCH JOINT EXERCISE THROUGH A COMMISSION PURSUANT TO §66.0301, STATS.

 

WHEREAS, by resolution adopted in 1995, the Town of Rutland ratified an agreement providing for the consolidation of the former Oregon Emergency Medical Services District and the Oregon Fire Protection District into a single fire protection and emergency medical services district now known as the Oregon Area Fire-EMS District (“District”);

 

WHEREAS, by its adoption of such resolution, the Town of Rutland agreed to be a participating municipality in the newly created District subject to the terms and conditions of the ratified agreement, entitled “Contract Providing for the Joint Operation and Maintenance of Fire Protection and Emergency Medical Services, and Providing for a Plan of Administration for such Joint Exercise through a Commission Pursuant to § 66.30, Stats.” (“Agreement”);

 

WHEREAS, the Agreement became effective on October 17, 1995;

 

WHEREAS, Section 3.01 of the Agreement describes the territory to be provided fire protection and emergency medical services by the District under the Agreement;

WHEREAS, Section 3.02 of the Agreement provides that, based on the request of a Party, the Parties may, by written amendment to the Agreement, enlarge or reduce the territory in the District; and

WHEREAS, the Town of Rutland has requested that certain of its territory not currently served with fire protection by the District be attached to the District for purposes of fire protection and that the area to be served with emergency medical services be adjusted to make the boundaries of the fire and EMS service areas the same.

NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Rutland, Dane County, Wisconsin, that the Town Board approves Amendment No. 4 to the Agreement, a copy of which is attached to this Resolution.

 

BE IT FURTHER RESOLVED, that the Town Chairperson and Clerk are authorized and directed to execute Amendment No. 4 to the Agreement and that the Clerk shall then forward the executed amendment to the Secretary of the Commission; and

 

Adopted by the Town Board of the Town of Rutland this   6th   day of November, 2007.
